Terms and Conditions

These terms govern the purchase and use of the services offered on nosurprice.net. By purchasing a service you accept them in full.

1. Who we are

  • GALAXY PICTURES

  • VAT No.: 10285550967
  • Email: admin@nosurprice.net
  • PEC: contimichelegavina@legalmail.it

2. Subject

We provide web hosting, reseller accounts, domain name registration and renewal and software licenses. The features and limits of each plan are those stated on the plan’s page at the time of purchase.

3. Formation of the contract

The contract is formed when you receive our order confirmation by email. To make a purchase, an account is required: guest checkout is not available, because every service must be linked to an identifiable holder in order to activate, invoice and support it.

We ask you to provide correct and up-to-date information. False or incomplete data, in particular that of a domain’s registrant, may prevent activation or lead to the Registry revoking the service.

4. Prices, taxes and invoicing

Prices shown on the Site are expressed in euros. Unless otherwise indicated:

  • to Italian consumers and Italian businesses, Italian VAT applies;
  • to consumers of other European Union Member States, VAT of their own country of residence applies: hosting services and licenses are electronically supplied services, taxed in the consumer’s country. We remit the tax through the OSS (One Stop Shop) scheme, and the rate applied is shown in the order summary before payment;
  • to businesses of other EU Member States with a valid VAT number verified through VIES, the reverse charge regime applies, without VAT being charged;
  • for customers outside the EU, the transaction is not subject to VAT under art. 7-ter of D.P.R. 633/1972.

For every order we issue an e-invoice, transmitted to the Sistema di Interscambio. For this we ask you for your tax code or VAT number and, if you have one, your SdI recipient code or PEC address.

5. Payments and automatic renewal

Payment is made at the time of the order, using the methods available at checkout.

Services run for a fixed term and renew automatically upon expiry, unless cancelled. This means that, if you chose a payment method that allows it and have not turned off renewal, we will charge the next fee without asking you to repeat the payment.

Before every renewal you receive an email notice with reasonable advance notice. You can turn off automatic renewal at any time from your customer area, without contacting us and without penalties: the service will remain active until the already-paid expiry date, and then stop.

If a renewal payment fails, we retry a limited number of times, notifying you each time. Once the grace period stated in the notice has passed, the service is suspended and subsequently terminated.

6. Activation

Activation starts automatically as soon as the payment is received: you don’t have to do anything, and you don’t have to wait for someone to notice.

“Automatic” doesn’t mean instant, though. Creating a web space, configuring it, and setting up mailboxes and certificates takes real time, and requests are processed in order of arrival: if there’s a queue ahead of you, your turn comes a few minutes later. It’s usually just a few minutes; at busier times it can take longer.

Registering a domain name also depends on the timing of the relevant Registry, which we don’t control: some extensions respond in moments, others require longer checks.

We email you when the service is ready, and we also email you if something gets stuck: we don’t leave you staring at a loading screen with no explanation. If the wait seems too long, open a ticket and we’ll check where things stand.

By requesting activation you agree that performance of the service will begin before the withdrawal period expires: the consequences are described in the Refund and Return Policy.

7. Domain names

Registering a domain is subject to the rules of the relevant Registry, which take precedence over these terms. In particular:

  • the domain is registered in your name: you are its registrant and retain ownership of it;
  • you can transfer it to another provider whenever you want, and we provide the necessary authorization code free of charge;
  • the Registry may refuse, suspend or revoke a registration according to its own rules, and in that case we are not liable;
  • amounts paid for registration, renewal or transfer are non-refundable, because they are paid immediately and definitively to the Registry. Details are in the Refund and Return Policy.

Renewing the domain is your responsibility: if you turn off automatic renewal and don’t take care of it, the domain will expire and may be registered by someone else.

8. Proper use of the service

You agree not to use the services for unlawful activities or activities that infringe the rights of others. In particular, the following are prohibited:

  • sending unsolicited mail (spam) and any form of unrequested messaging;
  • distributing malware, phishing, child sexual abuse material, or content that infringes copyright;
  • activities that compromise the stability or security of the server, or that consume resources to an extent that harms other customers on the same server;
  • attempts to gain unauthorized access to systems, whether ours or third parties’.

You are responsible for the content you publish and for your account credentials, which you must safeguard.

9. Permitted content and choice of IP address

We don’t play moral judge. On your space you can publish any content you like, provided it is lawful and compliant with the law: adult content included. We don’t question your tastes, your audience or your business model, and we don’t ask you to justify yourself.

We do ask you for one thing, though, and on that we don’t compromise.

IP addresses are classified by third parties — spam filters, reputation lists, parental control systems, mail providers — based on the content they host. An IP hosting adult material ends up, sooner or later, on lists that others use to block or downgrade it. If that IP is shared, the neighbors pay the price too: a restaurant’s email stops arriving, a medical practice’s website gets filtered by a school’s network. Through no fault of their own.

This is why we keep separate IPs by content category, and ask you to choose the right one when you order. The choice is yours to make, transparently: next to each option you’ll find the price, because a dedicated IP costs us, and so it costs you.

Knowingly choosing an IP unsuited to the content you intend to publish — for example the cheaper option while knowing the content requires the dedicated one — is a serious breach of these terms. In that case the web space is closed and no refund is due, for the remaining part of the fee or for any other amount, because the harm caused to the IP’s other customers cannot be undone by paying.

The opposite holds too, and we want to be just as clear about this: if you realize you got it wrong, or your site’s nature changes along the way, tell us. We’ll move you to the right IP, charging only the difference, with no penalties and no arguments. What matters to us is keeping the IPs clean, not punishing you: whoever says so on their own has nothing to fear, whoever hides it does.

10. Suspension and termination

We may suspend the service, notifying you, in the event of a breach of point 8, non-payment, or an order from the authorities. Where the severity allows it, we’ll tell you what to fix and give you a reasonable time to do so.

You can stop the service at any time by turning off renewal. Upon termination, the web space’s data is deleted: download a copy before it expires.

11. Backup

We run periodic backups for service continuity, but they don’t replace your own backups. You are required to keep independent copies of your data. On request we do our best to recover a backup, though we cannot guarantee the outcome.

12. Availability and liability

We are committed to keeping the services continuously available and to responding promptly to faults, but we do not guarantee uninterrupted, error-free operation. Excluded from our liability are disruptions due to causes not attributable to us, including infrastructure provider outages, cyberattacks, actions by the Registries, and force majeure.

Except in cases of willful misconduct or gross negligence, our liability is limited to the amount you paid for the affected service in the twelve months preceding the event.

13. Maintenance work

We may carry out scheduled maintenance, notifying you when it involves a foreseeable interruption. Urgent work for security reasons may be carried out without prior notice.

14. Right of withdrawal and refunds

The terms of withdrawal and refund, including exclusions, are set out on the Refund and Return Policy page, which forms an integral part of these terms.

15. Support

Support is requested via ticket from the customer area. We respond within the times stated on the Site; requests concerning a service disruption take priority.

16. Changes to these terms

We may amend these terms. Substantial changes will be notified to you by email with at least 30 days‘ notice; if you do not accept them, you may withdraw at no cost within that period.

17. Governing law and disputes

The contract is governed by Italian law.

For consumers, jurisdiction lies with the court of the consumer’s place of residence or elected domicile; for customers acting in the course of a professional activity, the Court of Turin has exclusive jurisdiction.

Before going to court you can turn to one of the alternative dispute resolution (ADR) bodies provided for by the Codice del Consumo (artt. 141 et seq.).

18. Data processing

The processing of personal data is described in the Privacy Policy.
